Chairman Glenn Johnston called the meeting to order.

 

Pledge of Allegiance to the Flag.

 

Roll call of Supervisors present showed William Lawhead, Edward Brown and Glenn Johnston all present.

 

Present: Secretary Barbara Shaffner, Code Officer Agatha Lauder-English, Solicitor Linda Lewis, Gweneth Fox, Susan Young, Paula & Jason Collins-Shaw Public Library, Amanda Thompson-WOKW, Kim Finnigan-The Courier Express, Jeff Corcino-The Progress, Steve McDole-Gant Daily.

 

Comments from the audience: Gwen Fox and Susan Young from the Shaw Public Library presented information to the supervisors and how the Library is funded and asked the supervisors to continue their yearly donation to the Library.

 

Engineer’s Report: The Supervisors received a letter from Stiffler McGraw & Associates asking if they wanted to proceed with Phase 3 for the Sanitary Sewer and explained the segments they could proceed with. The summary being

Areas tributary to the Hyde Lift Station              10,000 LF

All other areas                                                         19,500 LF

Preliminary construction cost

Hyde Area                    10,000 LF       =                 $ 1,500,000.

All other areas             19,500 LF      =                  $ 2,925,000.l

 

These costs include all appurtenances including manholes, laterals and building sewers.

This would result in the following annual debt service and user rate impact:

Hyde area                                  $ 100,000   ($3 increase per month per customer)

All other areas                         $ 195,000    ($6 increase per month per customer)

 

Edward Brown motion to instruct Solicitor to approach Financial Institutions for Financing and/or Bonds in the amount of $2 million for the Phase 3 Project, Glenn Johnston second Motion carried.

 

Supervisor Brown felt he would like to concentrate on the Hyde area and get the worst of other areas and try to keep the cost down. Supervisor Johnston would like to do the entire project if possible. Glenn Johnston motion to instruct Engineer to proceed with the design for the Hyde area and options for other areas, William Lawhead second. Motion carried.

 

The Engineer had also sent a Resolution of Plan Adoption to the Supervisors for consideration or approval. This Resolution is to approve Clearfield Municipal Authorities prepared Act 537 Plan that provides for the construction and operation of improved sewage conveyance and treatment/disposal facilities to serve the Clearfield Borough and Lawrence Township area. Glenn Johnston motion to approve Resolution #2012-12, Edward Brown second. Motion carried.

 

Police Report: None.

Solicitor’s Report: Ms. Lewis presented a Resolution to the Supervisors for their approval establishing an account known as Capital Reserve for the Act 13 Funds. Edward Brown motion to approve Resolution #2012-13, William Lawhead second. Motion carried.

 

Recreational Park Board: No Report.

 

Code Enforcement Officer: Agatha Lauder-English presented the following items for the supervisor’s approval.

A 2-Lot Subdivision for James R. Gray at 196 Jones Lane was approved by the Planning Commission and passed to the supervisors. William Lawhead motion to approve the James R. Gray Subdivision, Edward Brown second. Motion carried.

 

CW Krause & Sons LLC intends to Timber off of 21st Street and the Code Officer asked the supervisors to set a date and time for the Public Hearing for a Conditional Use. The date was set for December 18th, 2012 @ 6:50 P.M.

 

The Code Officer also reported that the Engineers comments have been met and the plans have been corrected for the Graystone Court Villas and the plans were ready to be signed.

 

Edward Brown motion to approve the Martell Zoning Amendment to the townships Zoning Ordinance and Zoning Map, William Lawhead second. Motion carried.

 

Secretary/Treasurer’s Report: The Treasurer’s Report for the month of October was submitted for the Supervisors review.

The Secretary asked the supervisors if they wanted to consider increasing her Bond now instead of waiting until the first of the year due to the Marcellus Shale Funds that the township received. Edward Brown motion to increase the Treasurer’s Bond to 2 million, Glenn Johnston second. Motion carried.

 

The Secretary reported that the individual that was cleaning both the township office and the Police Station handed in her resignation and asked if they wanted to advertise for someone to clean the buildings. William Lawhead motion to approve advertising for cleaning of the township offices, Glenn Johnston second. Motion carried.

 

The Secretary reported to the supervisors that because of the Act 13 funds they needed to revise the 2012 Budget for those funds. Edward Brown motion to approve Resolution #2012-14 to revise the 2012 Budget, Glenn Johnston second. Motion carried.

 

Supervisor Johnston explained to the public some of the details of the 2013 Budget and the details of what the supervisors intend to do with the Act 13 Funds that are included in the 2013 Budget.  Glenn Johnston motion to approve and advertise the Tentative 2013 Budget, William Lawhead second. Edward Brown voted no because his opinion is the voters have spoken that they do not want more police protection when they voted not to increase the millage by six mills to add on more Police Officers. He feels the township can put more boots on the street in a different manner and for a less amount of money. He did not feel the township should use the Act 13 Funds towards the increase in Police Officers.

Edward Brown motion to authorize the Solicitor to request quotes from Financial Institutions for the Tax Anticipation Note in the amount of $400,000.00, William Lawhead second. Motion carried.

 

Glenn Johnston motion to approve Resolution #2012-15 to establish a policy for Cell Phone Use by township employees during paid work time, William Lawhead second. Motion carried.

 

Glenn Johnston motion to advertise for a Police Chief and two (2) Part Time Officers, William Lawhead second. Edward Brown voting no. Motion carried.

 

The Secretary presented the Final Pay Estimate for DT Construction for the Forest Drive Project in the amount of $54,783.80. William Lawhead motion to approve the Final Pay Estimate to DT Construction in the amount of $54,783.80, Edward Brown second. Motion carried.

 

Supervisor’s Report:

Edward Brown: No Report.

 

William Lawhead let the public know that the Leaf Vac is done for the season but the township will still pick up bagged leaves as long as they are in the biodegradable bags.

 

Glenn Johnston: No Report.

 

Glenn Johnston motion to pay the list of bills in the amount of $78,556.87, Edward Brown second. Motion carried.

 

No other business to come before the Board, Edward Brown motion to adjourn to Executive Session, William Lawhead second.
