Chairman Glenn Johnston called the meeting to order.


Pledge of Allegiance to the Flag.


Roll call of supervisors showed William Lawhead, Edward Brown and Glenn Johnston all present.


Present: Secretary Barbara Shaffner, Code Officer Agatha Lauder-English, Solicitors James Naddeo & Linda Lewis,  Mike Boal-Novey Recycling,C.W. Krause & Bill Krause-CW Krause & Sons, Wendy Brion-The Progress, Steve McDole-Gant Daily, Kim Finnigan-The Courier Express, Amanda Thompson-WOKW, Tom Straw.


Comments from the audience:Mike Boal from Novey Recycling presented pictures and information to the supervisors regarding the Novey Recycling property  from previous years showing how the property was used.


William Lawhead motion to approve the minutes of the December 4th, 2012 meeting as written, Edward Brown second. Motion carried.


Engineer’s Report: No Report.


Police Report: No Report.


Solicitor’s Report: Mr. Naddeo was given a copy of a Resolution to review for the Police Pension Plan. This Resolution is done on a yearly basis and is to determine what the Police Pension Plan participant contribution rate is to be set at. William Lawhead motion to approve Resolution #2012-16 to set the participant contribution rate to 0% for 2013 for the Police Pension Plan, Edward Brown second. Motion carried.

The Solicitor drafted a letter for the Code Officer to use to send to residents enforcing an issue of connection to the public water supply when they are within the set distance of the main line.


The Solicitor drafted an agreement between the township and Elmo & Mary Braid for them to review regarding a private sewer system in a township right-of-way. Glenn Johnston motion to approve the agreement subject to Elmo & Mary Braid signing the agreement, Edward Brown second. Motion carried.


Solicitor Naddeo requested an Executive Session at the end of the meeting for a Personnel Issue and also a possible Litigation Issue.


Recreational Park Board: No Report.

Code Enforcement Officer: The Code Officer presented the Conditional Use submitted by CW Krause & Sons, LLC  for Timbering to the Supervisors for approval or disapproval. Edward Brown motion to approve the CW Krause Conditional Use of Timbering in a Rural Agriculture District for Judith Narehood and heirs off 21st Street, William Lawhead second. Motion carried.


The Code Officer announced to the supervisors and the public that her last day of work would be December 21st, 2012 before taking a maternity leave.


Secretary/Treasurer’s Report:

The Treasurer’s Report for the month of November was submitted for the Supervisors review.


The Secretary reported to the supervisors that a member of the Planning Commissions, Joyce Shirey’s, term would expire on December 31st, 2012 and she submitted a letter of resignation and would not be asking to be reappointed. The position was advertised but the township did not receive any letters of interest. Glenn Johnston motion to advertise the position on the Planning Commission Board again, William Lawhead second. Motion carried.

The Secretary also reported that the Planning Commission would like to close their PO Box and have the mail sent to the township office.


The Township received two letters of interest from township residents for the position on the Clearfield Municipal Authority. Gregory Dixon submitted a letter asking to be reappointed and Wayne Smith submitted a letter of interest. William Lawhead motion to reappoint Gregory Dixon to the Clearfield Municipal Authority with the term to run until January 1st, 2018, Edward Brown second. Motion carried.


William Lawhead motion to approve and adopt the 2013 Budget as presented, Glenn Johnston second. Edward Brown voting no. Motion approved.


The Secretary reported that the Recreational Park Grant was finalized and the township received the remaining funds for the grant. The first drawdown of funds were deposited into the Reserve Account until the project was completed and the Secretary asked permission to transfer the funds in the amount of $4,050.00 from the Reserve Account into the General Fund. Edward Brown motion to approve transfer of funds, William Lawhead second. Motion carried.


The Secretary reported that the date for the Supervisors Reorganizational Meeting is to be held on Monday, January 7th, 2013 and she asked what time they would like to start the meeting. The time was set for 6:30 P.M. with the Regular Meeting to immediately follow.


The Secretary reported that the township received a letter from the Joseph & Elizabeth Shaw Public Library asking the Board of Supervisors to consider appointing two members to the Board of Directors. William Lawhead motion to appoint Gwen Fox and Douglas Shimmel to the Board of Directors for the Joseph & Elizabeth Shaw Public Library, Glenn Johnston second. Motion carried.

The Secretary reported that the township received the Liquid Fuel Audit Reports for 2010 and 2011 and were available for the Supervisors to review.

Supervisor’s Report:

Edward Brown: No Report.


William Lawhead:Roadmasters Report:

Roadmaster Lawhead reported that he would like to look into a heavier roller to rent during the summer months. He is to get quotes for the cost to rent a roller.

Roadmaster Lawhead reported that he had to pull two trucks off the road that would not pass inspection both are 1990 Internationals.

Roadmaster Lawhead has two road projects that he would like the Engineers to look at that there is drainage problems with, being Mill Road and High Level Road.

On behalf of the township and the Board of Supervisors, Supervisor Lawhead thanked Joyce Shirey for her years of service on the Planning Commission Board.


Supervisor Johnston requested the supervisors set the date for interviews for the Part Time Police officer for January 9th, 2013 in the evening so all three supervisors and Chief Brooks would be available.


Supervisor Johnston explained a concern he had because of an application/resume for the Part Time Police Officer that was sent to the township by an individual that he knew and was not available with the resumes presented. He intended to look into the issue to find out what happened to the application.


Supervisor Johnston announced that he would like the township to consider hiring a township manager.


Supervisor Johnston asked for an Executive Session at the next township meeting being held on Monday January 7th, 2013 with Police Chief Mark Brooks and Police Officer Crystal Panebianco.


Glenn Johnston motion to pay the list of bills in the amount of $58,103.98, William Lawhead second. Motion carried.


Edward Brown motion to adjourn to Executive Session, Glenn Johnston second.

8:06 P.M.


Supervisor Johnston explained that because of a conflict of interest for the Solicitor with the Novey issue, the Solicitor recommends the township employee outside council.

Glenn Johnston motion to appoint special council, Kim Kesner, for this issue to review and report to the Board of Supervisors, Edward Brown second. Motion carried.


Mr. Naddeo explained that the Board of Supervisors decision to hire special council is to review the townships Ordinances and codes and inform the board of what their obligations are and to have an independent interpretation of what Ordinances apply to this issue.


Edward Brown motion to approve a Resolution to approve the Job Description for Police Chief, Glenn Johnston second. Motion carried.
