Chairman Glenn Johnston called the meeting to order.


Pledge of Allegiance to the Flag.


Roll call of Supervisors showed Glenn Johnston and Edward Brown present and William Lawhead absent.


Present: Secretary Barbara Shaffner, Solicitor’s James Naddeo & Linda Lewis, Cindy Peterson, Valerie Dixon and Paula Collins from the Public Library, Kim Finnigan-The Courier Express, Theresa Dunlap-Gant Daily,  Amanda Thompson-WOKW, Jeff Corcino-The Progress.


Comments from the audience: Cindy Peterson and Valerie Dixon spoke about what the Library has to offer and asked the supervisors to maintain or increase the townships yearly donation to the Library.


Edward Brown motion to approve the minutes of the October 1st, 2013 meeting as written, Glenn Johnston second. Motion carried.


Engineer’s Report: No Report.


Police Report: No Report.


Solicitor’s Report: Mr. Naddeo reported that he had spoken with the township Engineer and reviewed the Sanitary Sewer Project Phase III and is looking at the funding for the project. Mr. Naddeo felt it should be a tax free loan and that should lower the interest rate. The Board of Supervisors need to decide how much they want to borrow and he also explained it would be a self-liquidated note so it will not affect the debt service. The Supervisors estimated the project would cost around 2.3 Million but at this point do not have an exact estimateve the banks for the loan. Edward Brown motion to authorize the Solicitor to contact banks for interest rates and quotes for the sewer project, Glenn Johnston second. Motion carried.


The Solicitor prepared a Resolution for the supervisors to consider that the township will share the fines from DEP for the sewer with Clearfield Municipal Authority at 80/20. The decision was tabled to the next meeting. Supervisor Brown would like to see more information about the flow data before he makes a decision.


The Solicitor reported that he spoke with the union about the new Drug and Alcohol Policy that the township adopted. He explained that there is a policy in the Police Contract but not in the Roadcrew Contract. He needs to get a copy to the Union of the policy and the letter from DCED that requires the township to adopt the Policy. The Secretary is to get copies of everything to the Solicitor.

The Secretary had asked the Solicitor to look into a question that she was asked regarding Timbering in the township and if the township can required it to be a Conditional Use. The Solicitor explained that on August 29th, 2013 the Pa Legislator adopted a statue which states, Zoning Ordinances may not unreasonably restrict Forestry activities to encourage maintenance and management of Forestry with an open space and promote the conduct of Forestry as a sound and economic viable use of Forested Lands throughout this Commonwealth. Forestry activities included but not limited to Timber harvesting shall be a permitted use by right in all zoning districts in every municipality.  Mr. Naddeo felt the township can keep it as a Conditional Use in our Zoning but need to make some changes to the Zoning as it currently is not listed in any areas other than Rural Agriculture. The Supervisors will review the issue.


Supervisor Brown explained to the public that the township is being required to conduct house to house inspections for the sewer project. It will cost the township $40.00 per house. This is going to happen and will happen because the township is required. Mr. Brown warned residents if they have downspouts, French drains, sump pumps, etc  going into the sanitary sewer system they need to get it corrected now. The inspections will include exterior and interior inspections of the residents in the township on Sanitary Sewer. Township will consider passing the cost to the residents for any fines the township has to pay.


Recreational Park Board: No Report.



Code Enforcement Officer: No Report.



Secretary/Treasurer’s Report:


The Treasurer’s Report for the month of September was submitted to the supervisors for their review.


A Conditional Use was submitted by CW Krause for Timbering on 21st Street. The Planning Commission approved and the township needs to set a date and time for the Public Hearing. Edward Brown motion to set the date for the Public Hearing for the Conditional Use on November 5th, 2013 @ 6:50 P.M., Glenn Johnston second. Motion carried.


The Secretary presented two Subdivision for the supervisors’ approval:

(2) Two Lot Subdivision for Cheryl Martin on Mill Road submitted by Yost Surveying. Removing one line to add to her property, additional lot separated to possibly sell in the future. Everything in order and approved by Planning Commission. Glenn Johnston motion to approve, Edward Brown second. Motion carried.

(1) One lot Subdivision for Robert Kurtz Jr. located on Charles Road submitted by Yost Surveying. Mr. Kurtz is selling lot to Bishops as a lot addition. Everything in order and approved by Planning Commission. Edward Brown motion to approve, Glenn Johnston second. Motion carried.


The Secretary asked the supervisors to set dates to start working on the 2014 Budget. The dates were set for October 22nd @ 6:00 PM and October 23rd @ 6:30 PM.

Glenn Johnston motion to accept bid from Woodland Equipment & Supply for the 1B Limestone @ $14.79 per ton and Bucktail Excavators for 6S Anti Skid @ 13.97 per ton, Edward Brown second. Motion carried.


The Secretary reported that Roadmaster Lawhead asked her to announce that he has been contacted by the Bus Company about issues with tree branches catching on the top of their buses and he has checked the complaint out and he found that there are issues with some trees. The areas are Centre Street, Charles Road and West Pauline Drive. The township will be sending out letters to the property owners that they must trim the trees.

Glenn Johnston motion to hire Brian Lockwood as a Part Time Police Officer, Edward Brown second. Motion carried.


Edward Brown motion to pay the list of bills in the amount of $102,595.09, Glenn Johnston second. Motion carried.


No other business to come before the Board.
