Chairman Glenn Johnston called the meeting to order.

 

Pledge of Allegiance to the Flag.

 

Roll call showed William Lawhead, Edward Brown and Glenn Johnston all present.

 

Present: Secretary Barbara Shaffner, Police Chief Mark Brooks, Solicitor James Naddeo, Code Enforcement Officer Agatha Lauder-English.

Public Comments: Elliott Neeper, Mill Road Fire Co Chief, asked the supervisors to consider requiring businesses located in the township to install knox boxes outside of their businesses for emergencies. The Fire Companies have experienced false alarms at several businesses with multiple times and waiting for the owner or manager to arrive with the key to get in instead of breaking down doors. This knox box would enable the emergency personnel to get into the buildings immediately and that would help with less time being spent waiting on keys to be sure there is not a fire inside the building and not having to destroy doors trying to get in. Supervisors Bill Lawhead and Edward Brown both felt it should be the business owner’s decision if they want to have a box outside of their business. Chief Neeper explained that they have issues with numerous businesses that have false alarms quit often. It was discussed to possibly adopt an Ordinance that if a business had more than three false alarms they would be required to install a knox box. Edward Brown motion to direct the Solicitor to review and draft an Ordinance and make recommendations to the Board of Supervisors, William Lawhead second. Motion carried.

 

William Lawhead motion to approve the minutes of the October 15th, 2013 meeting as written, Edward Brown second. Motion carried.

 

Engineer’s Report: No Report.

 

Police Report: Chief Brooks submitted the stats for the month of October for the Supervisors review.

 

Chief Brooks reported that the new Part Time Officer, Brian Lockwood completed his training.

 

Chief Brooks also reported that the Police Department was invited to the Clearfield Elementary School and presented a Drug Awareness Program that went very well.

 

The Police Department also participated in a Ride A Long Program.

 

Chief Brooks reached out to the public for assistance in any information pertaining to the armed robbery that occurred at the Hyde Unimart. He distributed photos to the media and the public.

Solicitor’s Report:Mr Naddeo reviewed a letter pertaining to the traffic signals that Pa Waste would like to update and make changes to on SR 879 that is the route the waste haulers would be using to get to the Camp Hill Land Fill. It was agreed that Pa Waste would install the light control system and be responsible for the maintenance to the system and the township would continue to replace any bulbs in the signals. It was requested that the supervisors sign a letter stating they were included and were aware of Pa Waste intentions. William Lawhead motion to approve the Chairman to sign the letter, Edward Brown second. Motion carried.

Glen Richey Fire Co.would like to hold tournaments at their ball field and inquired about a concern they have with individuals or organizations using the field and asked if they should have a release of liability. Mr. Naddeo suggested possibly an Indemnification Agreement. Supervisor Lawhead asked the Solicitor to put it in writing what his recommendation is so he can give it to the Fire Company.

 

The Supervisors discussed the ongoing issue the township has with Workers Compensation claims and the increase in the Fire Departments Workers Compensation. It may be possible to incorporate an agreement so the Fire Departments have to ask the supervisors permission to hold fund raising events, etc for the townships workers compensation to be responsible for injuries. The supervisors will discuss the issue with the Solicitor and look at what the law allows.

 

The Solicitor prepared an Ordinance for the supervisors to review pertaining to tree removal or trimming of trees in township right of ways.

 

Because the township had to adopt a Drug & Alcohol Policy to be in compliance with DCED requirements for the CDBG Funds, the Solicitor needs to make the Roadcrew Union representative aware of it. There is already a section in the Police Contract that covers the issue but not in the Roadcrew Contract. William Lawhead motion to approve the Solicitor to send a letter to the Teamsters Union Representative for the Roadcrew about the Drug & Alcohol Policy, Edward Brown second. Motion carried.

 

Mr. Naddeo received the quotes from the Banks for the Sanitary Sewer Project Phase III but wants to review them with the townships CPA and prepare amortization schedules for the loans before presenting them to the Board of Supervisors.

 

Mr. Naddeo explained to the Supervisors that there was a law change that states you cannot preclude Timbering in any zoning area of the township. He recommended that the supervisors review the issue and make some changes to the Zoning Ordinance

 

Recreational Park Board: No Report.

 

Code/Zoning Enforcement Officer: Agatha Lauder-English asked the supervisors for their decision from the Conditional Use Hearing for CW Krause & Sons for Timbering on 21st Street on the Cora Owens & Heirs property. William Lawhead motion to approve the request, Edward Brown second. Motion carried.

 

The Code Officer was given a Sewer Facility Planning Module for Martell Glass that needed the chairman’s signature. Edward Brown motion to approve the Chairman to sign, William Lawhead second. Motion carried.

 

Secretary/Treasurer’s Report:

The Secretary reported that she received the price quote for the Road Salt for the 2013-2014 season @ $53.83 per ton.

The Secretary opened the bid for the Police Vehicle and only received one bid.

The Secretary reported that there are two terms expiring on the Planning Commission. The Secretary sent the two members a letter to remind them to send a letter to the township if they want to be reappointed but also asked the Board of Supervisors if they wanted the terms advertised. William Lawhead motion to advertise, Edward Brown second. Motion carried.

 

The Secretary presented the proposed 2014 Budget and explained the changes she made to the budget after the last budget meeting to add items they did not have figures on yet. Glenn Johnston motion to approve the 2014 Tentative Budget and advertise it, Edward Brown second. Motion carried.

 

Supervisor’s Report:

Edward Brown: An agreement was presented to the supervisors from the Clearfield Municipal Authority for the township to split the cost of the fines from DEP for the overflow of infiltration into the Susquehanna River. The agreement presented from the Clearfield Municipal Authority requested a 80/20 split but Supervisor Brown felt it should be a 70/30 Split. Edward Brown motion to approach the Clearfield Municipal Authority for a 70/30 split for the fines and limit the term to the end of the final inspection of the townships Sanitary Sewer Project Phase III, Glenn Johnston second. William Lawhead nay.

Supervisor Lawhead asked the Solicitor about a property owner that is complaining about water coming onto her property from her neighbors due to downspouts and creating erosion. It is in the Zoning Ordinance that under performance standards it states no erosion by wind or water shall be permitted which carry objectionable substances onto neighboring properties. Mr. Naddeo recommended a letter be sent to the property owner that they need to redirect the water from their property.

 

Supervisor Lawhead reported that he ordered Street & Bridge Signs.

 

Supervisor Lawhead got information on an Ordinance that would require a property that is being sold to be inspected for their Sanitary Sewer and be sure they do not have surface water going into the Sanitary Sewer System. He gave a copy of it to the Solicitor for his review.

Glenn Johnston motion to hire Debra Finkbeiner as a Part Time Code/Zoning Officer at $ 12.00 an hour and $25.00 per meeting pay, Edward Brown second. Motion carried.

 

William Lawhead motion to pay the list of bills in the amount of $ 69,831.76, Edward Brown second. Motion carried.
