Vice Chairman Daniel Mitchell called the meeting to order.

 

Pledge of Allegiance to the Flag.

 

Roll call of Supervisors showed Edward Brown and Daniel Mitchell both present with William Lawhead absent.

 

Comments from the audience: Jerri Young of Linn Realty Group was present and let the supervisor know that she is handling the sale of the Lingle property that is listed at 1.1 million located off Interstate 80 and SR 879. She asked the supervisors if they know anything about the property that she may not know. She questioned if there is any wet lands on the property and was advised by Attorney Naddeo to contact DEP for that information. She also asked if there were any types of businesses that the supervisors would be averse to being located on the property. Attorney Naddeo advised her that as long as it’s lawful activity and meets the townships Ordinances and Zoning requirements.

 

Daniel Mitchell motion to approve the minutes of the September 16th, 2014 meeting as written, Edward Brown second. Motion carried.

 

Engineer’s Report: No Report.

 

Police Report: A copy of the Stats for the month of September was submitted to the supervisors for their review.

 

Solicitor’s Report:Mr. Naddeo had 2 Personnel issues to present to the supervisors in Executive Session.

 

It was brought to the Solicitor’s attention that there was an error in the Junk Yard Ordinance that needed corrected in Paragraph D for the 100-150 Ft. needs to be added. Daniel Mitchell motion to amend Ordinance # 2013-02, Edward Brown second. Motion carried.

 

The Solicitor looked at the question of not allowing parking in Cul-de-sacs. He looked at the vehicle code for parking restrictions and there are none. If the board wants to restrict parking in cul-de-sacs then they would need to adopt an Ordinance. The Board will review before making a decision.

 

A Ticketing Ordinance was presented to the Solicitor for his review. This would be for the Code Officer to be allowed to ticket individuals that violate the codes. The Board of Supervisors did not make a decision on the Ordinance.

 

The Solicitor prepared a Lease Agreement for Site Control for the property at 314 High Street Clearfield with Chris & Tina Barrett and Lawrence Township. This is part of the Blighted Property Program Funds from Clearfield County. Edward Brown motion to approve the Lease Agreement and authorize the Chairman to sign the agreement, Daniel Mitchell second. Motion carried.

Recreational Park Board: No Report.

 

Code Enforcement Officer: No Report.

 

Secretary/Treasurer:The Secretary received a letter from the Clearfield County Cross Country Team requesting permission to use township roads for their 3rd annual Bison Stampede 5k to be held on November 8th, 2014 starting at 9:30 AM. The course will follow George Rd, Warren Drive, Village Road, Cresent Drive, Joseph Road, Dairy Lane and Parkview Drive. Daniel Mitchell motion to approve, Edward Brown second. Motion carried.

 

The Secretary reported that the township received the Pension State Aid on September 30th, 2014 in the amount of 92,944.32 and asked permission to transfer the funds into the Police Pension Plan. Edward Brown motion to approve the transfer of funds, Daniel Mitchell second. Motion carried.

 

The Secretary also asked permission to transfer the remaining funds needed to meet the Police Pension Plan MMO for 2014 in the amount of 75,736.68 from the General Fund to the Police Pension Plan. Their total MMO for 2014 is 168,681.00. Daniel Mitchell motion to approve the transfer of funds, Edward Brown second. Motion carried.

 

The Secretary also reported that the township received the state aid allocation for the Volunteer Fire Relief in the amount of 42,072.03 and asked permission to pay the funds to the Lawrence Township Volunteer Fire Relief Association. Daniel Mitchell motion to pay the Fire Relief the allotted state aid, Edward Brown second. Motion carried.

 

The Secretary presented dates to the supervisors for the Leaf Pick Up schedule that would start October 20th, 2014 and end on November 21st, 2014. The supervisors present agreed with the dates set.

 

A request was presented to the Board of Supervisors from William Lawhead asking the Board to reimburse him for his Dental & Vision expenses while he is temporarily working as a Roadmaster. Daniel Mitchell motion to approve, Edward Brown second. Motion carried.

 

The Secretary reported that the township received Pay Estimate #4 from Diehl Contracting in the amount of $169,015.02 for the Phase III Sewer Project. Edward Brown motion to pay invoice, Daniel Mitchell second. Motion carried.

 

The Secretary also reported that the township received Pay Estimate #2 from Greenland Construction in the amount of 194,899.62 for the Mill Road Project. Daniel Mitchell motion to pay invoice, Edward Brown second. Motion carried.

 

The Secretary asked permission to transfer funds from the Act13 account to the General Fund to pay the Greenland Construction Invoice. Edward Brown motion to approve the transfer of funds, Daniel Mitchell second. Motion carried.

 

The Secretary presented two Invoices she received after she had completed the agenda and asked permission to pay the two Invoices to Naddeo & Lewis in the total amount of 28,500.00. Edward Brown motion to approve payment of Invoices, Daniel Mitchell second. Motion carried.

Supervisor’s Report:

Edward Brown: No Report.

 

Daniel Mitchell:

Roadmaster Report: Roadmaster Mitchell reported that the Roadcrew has been working on Pot Holes and will be doing work with the paver on Williams Road this week. They continue to work at the Compost Site to keep it cleaned up. They have been doing Smoke Testing and have done 4 homes. They did the ditches on Pifer Road and are working on the trucks.

 

Daniel Mitchell motion to approve the request from the roadcrew asking permission to stay on the 4/10 hour days until the end of October and to stay at the same start time, Edward Brown second. Motion carried.

 

Supervisor Mitchell received a quote to update the radios for in the road equipment and asked the Secretary to look into getting a grant to help pay for the radios before making a decision on purchasing them. This is something that will need to be done because next year the township will need to update to digital. The cost is approximately 18,000.00.

 

Supervisor Mitchell presented a quote for the purchase of a new medium sized Peterbilt Dump Truck at the purchase price of 175, 533.00. Supervisor Brown asked the Secretary if the funds are available to purchase the unit.

The township can use funds from Act 13 and also there are funds

available in the reserve account. Since the unit will not be delivered until 2015 then the Board can also put the remaining funds needed in the 2015 budget.

 

The Secretary read a statement from Supervisor Lawhead opposing the purchase of the unit: “I do not believe we need to purchase this truck at this time. 175,000.00 is too much to take out of our Reserve Funds. We may lose our Act 13 Impact Fee next year and if we do we will need our Reserve Funds to do the projects needed in Lawrence Township. I suggested a purchase of a smaller truck and an update to the plow on one other truck as an alternative purchase, but was shut down. In talking with the roadcrew members they felt the truck was not needed but a replacement for one of the Ford F-550’s, which is a 2002 model, was better for the township. I cannot be here for the meeting because of work, but I want my opinion known to all”.

Supervisor Brown stated that he respected Supervisor Lawheads opinion but felt the township needed a mid-size truck. He agreed to stop the work on the repairs to the 1988 International and include that unit in with the items for auction.

Daniel Mitchell motion to purchase the Peterbilt from Walsh Equipment in the amount of 175,533.00, Edward Brown second. Motion carried.

Supervisor Mitchell addressed a letter that the Board of Supervisors received from a township resident, Chris Cutler, asking the board to paint lines on Riverview Road. The Secretary gave Supervisor Mitchell prices on what it would cost to paint lines on township roads, with the price at approximately .30 LF. He explained that the township cannot afford to paint lines on all the township roads. He did thank Mrs. Cutler for sending the letter of request.

 

Edward Brown motion to pay the list of bills in the amount of $92,711.36, Daniel Mitchell second. Motion carried.
