Chairman William Lawhead called the meeting to order.

 

Pledge of allegiance to the Flag.

 

Roll call of supervisors showed Edward Brown, Daniel Mitchell and William Lawhead all present.

 

Present Secretary Barbara Shaffner, Code Officer Debra Finkbeiner, Solicitors James Naddeo & Linda Lewis, Randy Powell, Nancy Yeager, Bob & Franny Greenland, Scott Schultz, Joe Peters, Jim Hoover, Tim Durant, Bill Sauserman, Theresa Dunlap, Jeff Corcino.

 

Comments from the audience: Clint Goss presented a request to the Board of Supervisors asking them to consider adding Churches as an allowed use in all zoned areas of the township. He thanked all employees of the township for their service and work, as the Bible states in Romans 13, give honor to our Governing officials. In the history of our country churches were put in store fronts, homes, etc. Using unconventional spaces that have been vacant can be an economic benefit to the township. Again his request was to add churches as an allowed use in all zoned areas of the township.

 

Tim Durant was present to represent Faith Bible Church. The Bridge, located in the former Target Square presently owed by the Greenlands, is part of their ministry and have been at their location for nearly 2 years. They were recently denied the use of the church at this location and asked the Board of Supervisors to consider a change to add churches as permitted use. He read paragraph C of Section 125-14 of the townships zoning code “Where a use is proposed which is similar in nature and intent to those already listed in a zoning district, but not actually listed therein, the Zoning Officer shall refer the request to the Planning Commission. The Planning Commission shall review the request and forward its recommendations to the Township Supervisors. The Supervisors shall approve or deny the request based upon: (1) The recommendations of the Planning Commission. (2) The similarity of the use to the listed uses and intent of the district.” He pointed out numerous similar uses, and again asked the supervisors to consider and make the modifications to add churches as an allowed use in all zoned areas of the township.

 

Pastor Scott Schultz explained that they were not aware they were not properly zoned and apologized for the error of operating as a church in the zoned area that was not permitted.

 

Daniel Mitchell motion to approve the minutes of the July 7th, 2015 meeting as written, Edward Brown second. Motion carried.

Solicitor’s Report: Mr. Naddeo presented an Ordinance to amend the Sewage and Water Ordinance adopted December 11, 1958 and amended September 4th, 2012 that was ready for the supervisor’s approval. Edward Brown motion to approve Ordinance #2015-05, Daniel Mitchell second. Motion carried.

Mr. Naddeo asked for an Executive Session for a possible litigation.

 

Recreational Park Board: No Report.

 

Code Enforcement Officer: Debra Finkbeiner presented the Zalno/Siebenrock  Subdivision located on Goshen Road and was approved by the Planning Commission, everything was in order. William Lawhead motion to approve the Zalno/Siebenrock Subdivision, Daniel Mitchell second. Motion carried.

The Code Officer also presented a minor alteration Land Development Plan for Sheetz off SR 879 and asked the supervisors to waive the fencing requirement for the retention pond. Edward Brown motion to approve the Minor Alteration Land Development Plan for Sheetz and waive the fencing for the retention pond, William Lawhead second. Motion carried.

 

Sheetz also submitted a LERTA request with their Building Permit for the work in the amount of $1,160,000.00. Edward Brown motion to approve the LERTA request for Sheetz, William Lawhead second. Motion carried.

 

The Code Officer asked the supervisors to approve and authorize Stiffler McGraw to perform the Dye Testing for the downspouts inspections in the township. Edward Brown motion to approve Stiffler McGraw & Associates to do the downspouts inspections, Daniel Mitchell second. Motion carried.

 

Code Officer Finkbeiner reported that she is still working on violations of swimming pools that were put in without permits and reminded residents that they have to get a building permit to be in compliance, if a child or anyone would get injured in their pool and they did not have a permit and it was not properly inspected they would be liable and their insurance may not cover the issue.

 

The Code Officer reported that illegal burning is being done on the weekends and she is being informed of the problems and fines will be issued. She has also received complaints for outdoor furnaces and reminded those that use them that the furnace has to be in compliance and not allowed to burn garbage.

 

Roadmaster Report: Roadmaster Woodling would like to get the School Crossing Guard House at the Plymptonville Bridge removed and he had two request from individuals that would like to purchase the materials from the building. He was instructed to get sealed bids from those interested and give the material to the highest bidder. He also questioned taking down the school crossing signals and if he could contact someone to take them down. He was told by the supervisors that all electric to the lights has been disconnected and the Roadcrew can use the bucket truck and take the lights down.

 

Roadmaster Woodling gave the supervisors an update on the paving project and where they are with the project.

 

He also reported that after the storms over the weekend they had washouts on McGeorge Road, Lick Run Road and Bowmans Hill Road and the crew has been out getting them back into shape.

Secretary/Treasurer’s Report: The Treasurer’s Report for the month of June was submitted for the supervisors review.

 

The Secretary explained that at the last township meeting the board had approved a Sewer Surcharge Exoneration for Scott Kelly on Flegal Road and apparently he had paid his surcharge from 2002 until June 2015 with the total amount being $789.75 and is asking for reimbursement of those funds. William Lawhead motion to approve reimbursement to Scott Kelly in the amount of $789.75 for the Sewer Surcharge, Edward Brown second. Motion carried.

 

Fire Chief Neeper submitted an updated Drivers List for the Hyde Fire Company and the list was submitted to the Board of Supervisors for their review and signatures.

 

The Secretary received a quote to replace a regular swing and a toddler swing at the Recreational Park and also the nylon nets at the basketball court with the total quote of $299.00 plus $25.00 for shipping. Edward Brown motion to approve the quote and order the equipment, William Lawhead second. Motion carried.

 

The Secretary/Treasurer asked permission to transfer funds from the Act 13 Savings Account to the General Fund in the amount of $39,713.22 for the second quarter Part time Police Officers wages and FICA expenses. Daniel Mitchell motion to approve the transfer of funds, Edward Brown second. Motion carried.

 

The Secretary presented a Disable Veterans Real Property Tax Exemption Certification that was approved by the Department of Military & Veterans Affairs for the supervisors review and approval. Edward Brown motion to approve the Disabled Veterans Real Property Exemption, William Lawhead second. Motion carried.

 

The Secretary presented two Invoices from the Clearfield Municipal Authority for the Hyde SSO rain events and the townships share of the fines with the event on 6/23/2015 cost of $600.00 and on 6/27/15, 6/28/15 and 6/29/15 the fine being $3,000.00. Edward Brown motion to approve payment for fines pending review and approval from Stiffler McGraw & Associates, Daniel Mitchell second. Motion carried.

 

Supervisors Report:

Edward Brown explained that the Supervisors have been reviewing the funds in the Sanitary Sewer Account and will need to increase the sewer surcharge in order to pay the expenses associated with the Sewer System. Presently the expenses are higher than the income by approximately $135,000.00 for the year. They will review the information with their Engineers and evaluate how much they will need to increase the sewer surcharge.
