Vice Chairman Daniel Mitchell called the meeting to order.

 

Pledge of Allegiance to the Flag.

 

Roll call of supervisors showed Edward Brown and Daniel Mitchell present with William Lawhead absent.

 

Comments from the audience: None.

 

Edward Brown motion to approve the minutes of the September 15th, 2015 meeting as written, Daniel Mitchell second. Motion carried.

 

Engineer’s Report: No Report.

 

Police Report: Sergeant Glass reported that District Attorney William A. Shaw Jr. has training scheduled on October. 26, 2015 for the new Clearfield County Juvenile Advocacy Center. Glass said Shaw obtained grant funding to cover the cost of the training, and noted that Sgt. Crystal Panebianco would most likely participate in the training.

 

Sergeant Glass reported that the District Magistrate asked both the Lawrence Township Police Department along with the Clearfield Borough Police Department to schedule October 26th, 2015 from 9:00AM-7:00PM to serve outstanding warrants. This would mean 8 regular hours and 8 overtime hours for three Officers for the township. Edward Brown motion to approve the hours to serve warrants, Daniel Mitchell second. Motion carried.

 

Solicitors’ Report:The Solicitor had an enquiry pertaining to an alley near the Clearfield Soccer Association property off of Coal Hill Road. Supervisor Brown explained that the township does not maintain the alley in question.

 

The Solicitor asked for an Executive Session for a potential litigation.

 

Recreational Park Board: No Report.

 

Code Enforcement Officer:The Code Officer presented a Subdivision for Cresswood Co. LLC located off SR879-Clearfield Shawville Hwy, Clearfield known as 160 Cresswood Drive Clfd Pa. The application was submitted by GeoTech and was reviewed by the township Planning Commission and approved. Daniel Mitchell motion to approve the Cresswood Subdivision, Edward Brown second. Motion carried.

 

The Code Officer asked the supervisors to set a date for a Conditional Use Hearing for Reed Ventures located at 2983 and 2928 Washington Avenue, Clearfield PA. Daniel Mitchell motion to set the date for the Public Hearing for November 17th, 2015 @ 6:45 P.M., Edward Brown second. Motion carried.

The Code Officer reported the timbering is completed on Flegal Road and a final inspection of the roadway was performed on October 20th, 2015 with no fractions noted. Roadmaster Ron Woodling advised the Code Enforcement Officer to proceed with the release of the Bond. Edward Brown motion to approve the release of Bond, Daniel Mitchell second. Motion carried.

 

The Code Officer reported that the Clearfield Soccer Association has submitted plans for a Grinder Pump Lateral Installation to the township and the review has been completed by Stiffler McGraw & Associates. The review and comments have been submitted to the Clearfield Soccer Association Engineer, Kevin W. Bloom P.E./Bloom & Associates.

 

Code Officer Finkbeiner has been working on reviewing the Signage Ordinances and possible updates and changes and asked permission for the Solicitor to review the changes. Daniel Mitchell motion to approve Solicitors review, Edward Brown second. Motion carried.

 

The Code/Zoning Officer reminded residents that all land transfers require a sewer and downspout inspection prior to transfer.

 

Ms. Finkbeiner also reported that she has received numerous complaints of burning, grass overgrowth, weeds and unlicensed vehicles. Grass and weeds over 10 inches is a code violation. No burning of garbage and construction debris, un-inspected and unlicensed vehicles over 15 days expiration is also a code violation.

 

Ms. Finkbeiner also reported that the Roadcrew and roadmaster continue working with her inspecting for I/I in sewer system. Mobile home park owners inspect your connections to sewer lines, if it is not sealed under a trailer and piping is below grade and at grade level. Make arrangements to replace, repair, inspect caps and make sure all vent caps are on. Cap all laterals on vacant lots.

 

Roadmaster Report: Roadmaster Woodling reported that the Roadcrew has started the Leaf Vac Schedule. They have been updating the Stop Signs and winding down with the summer projects trying to get them completed before the winter weather. They are also starting to get the road equipment ready for winter. He also reported that the Case Backhoe is presently in the shop at Performance Fuel for a fuel pump repair and they had to put new spindles on the 1997 Ford F800.

 

Secretary/Treasurer’s Report:The Treasurer’s Report for the month of September was submitted for the supervisors review.

 

The Secretary reported that the township received the remaining funds for the Dirt & Gravel Road Project in the amount of $5,635.76. The township received the first payment of $8,274.34 in April and was deposited into the Reserve Account. The Secretary/Treasurer asked permission to transfer those funds from the Reserve Account to the General Fund to reimburse the expenses for the project. Edward Brown motion to approve the transfer of funds from the Reserve Account to the General Fund in the amount of $8,274.34, Daniel Mitchell second. Motion carried.

 

The Secretary prepared the 3rd Quarter Reports for the MON 30 in the amount of $4,982.03 and MON 71 in the amount of $132.66 Montgomery Run Projects and asked permission to submit those reports and authorize the chairman to sign the documents. Daniel Mitchell motion to approve the draw of funds for the projects and authorize the chairman to sign the documents, Edward Brown second. Motion carried.

The Secretary presented a request from Bruce Fair for reimbursement for his Sewer Surcharge because of a waterleak. Clearfield Municipal Authority shows that the adjusted amount would be 416.00 for the overage billed due to the leak in the September bill but they did not know the total amount up to the date the leak was repaired until they do the November reading. She asked if the supervisors wanted to wait and pay the total amount after that reading and reimburse the total amount then or pay Mr. Fair the $416.00 now and reimburse the difference after the next reading. Edward Brown motion to reimburse Bruce Fair the $416.00 for the present reading, Daniel Mitchell second. Motion carried.

 

The Secretary let the public know there will be a Public Meeting at the Clearfield Jr. Sr. High School on Wednesday October 28th, 2015 at 7:00 P.M. to inform the public the work that has been done to date on the Feasibility Study for a possible consolidation between Clearfield Borough and Lawrence Township.

 

The Secretary/Treasurer asked permission to transfer funds from the Permit Fee Account to the Reserve Account for the funds from the 2014 Fees in the amount of $67,713.10. Edward Brown motion to approve the transfer of funds, Daniel Mitchell second. Motion carried.

 

The Secretary presented for approval Pay Estimate #15 to Diehl Contracting in the amount of $10,849.84. Edward Brown motion to approve Pay Estimate #15 in the amount of $10,849.84, Daniel Mitchell second. Motion carried.

 

The Secretary asked for dates to set for Budget Meetings. The supervisors agreed that they would be available most days or evenings and she would check Supervisor Lawheads work schedule to get the meetings scheduled and advertised.

 

A request was submitted to the Secretary for a No Outlet sign to be installed at the end of Barn Road. They have numerous children playing and seem to get a lot of traffic that does not realize it is a dead-end road. Supervisor Brown explained that at the entrance to Barn Road there is not a location they would be able to put up a sign and that is one reason there is not a sign there.

 

Supervisor’s Report:

Supervisor Brown asked the Solicitor if he reviewed his request from the last meeting to possibly adopt a Resolution that the township could borrow from the General Fund to the Sewer Fund when needed but it would be required to be paid back within six months or the supervisors would be required to raise the sewer surcharge fee. Solicitor Naddeo explained that the township received DCED approval for the Sewer Loans based on the fact that it is a self-liquidating loan. The township certified they would increase the sewer surcharge when needed to pay the loan and this would be a violation of the loan agreement.

Edward Brown motion to hire Chris Pentz as special counsel for a Legal issue for collection of funds from a previous employee where Mr. Naddeo may have a conflict, Daniel Mitchell second. Motion carried.
