Chairman Randy Powell called the meeting to order.

 

Pledge of Allegiance to the Flag.

 

Roll call of Supervisors showed Daniel Mitchell, William Lawhead and Randy Powell all present.

 

Comments from the audience:

Randy Lemmo noted that a democracy is where the people decide the course of government while a dictatorship is where one or a handful of people decide. He asked the supervisors to allow democracy to prevail and give the people the chance to vote.

Joan McMillen asked that the supervisors allow the people to decide if they want the consolidation between Clearfield Borough and Lawrence Township and to approve the Ordinance to put the question on the ballot.

Jim Moore-As a resident and a voting constituent of Lawrence Township, who voted for each of you Supervisors, I appeal to your sense of duty and voter responsibility to see that the issue is approved for ballot referendum so I and mine have a fair chance to hear, weigh and discern the arguments that can only come forward with your vote to approve this issue of Consolidation consideration for the Lawrence Township voters. A “No” vote to preclude this issue from ballot referendum would smack of a Socialist form of government, thus depriving our citizens of all our Democratic right in this matter.

He wanted and expect the supervisors to protect his inalienable right to cast his vote in this regard.

 

Alan Walker has been a resident of the township for over 27 years and explained that he served as Secretary for the Department of Community and Economic Development for four years. He also explained that under Act 47 for distressed communities if that happens to Lawrence Township of Clearfield Borough then an outside group would come in and make the decisions for the township or borough. Every year the township and borough submit their financial information to DCED, four years ago both the township and borough showed up on the report for potential as a distressed community. The State has an early intervention program and that is where the 100,000.00 grant came from the do the study that has been done for the possible consolidation. He asked the Supervisors to put the question on the ballot and give the residents the opportunity to decide.

 

A resident asked the supervisors if they believe this is going to help the township residents. Supervisor Powell said that he received over 160 calls and only had two people in favor of putting it on the ballot.

 

Steve Ressler explained that under Act 47 has anyone looked into the list. Everyone on the list is either a City or Borough and there are no longer townships on the list. He felt the township is better off than Clearfield Borough and that is why Clearfield Borough is pushing for the consolidation. The township has nothing to gain from this consolidation and nothing has been said of how it’s going to help the residents of the township.

Rodger Read asked if there are other alternatives for the township and possibly go to court and ask for a Tax increase if needed.

There was discussion by Supervisor Powell and Mitchell that it was not on the agenda and they were not aware that they were voting on the issue at this meeting and thought it was being voted on Thursday night and did not want to vote on the issue at this meeting. Solicitor Naddeo then explained that what they would be voting on at this meeting is to advertise the Ordinance and not to officially adopt the Ordinance until the next township meeting.

 

Randy Lemmo commented that this is why the township needs a professional manager or consolidation because of circumstances like this where the board does not communicate or are awhere of what is going on in the township.

Robert Clark asked that the supervisors do not put the question on the ballot.

 

William Lawhead motion to approve the minutes of the January 3rd, 2017 meeting as written, Randy Powell second. Motion carried.

 

Engineer’s Report: No Report.

 

Police Report: No Report.

 

Solicitor’s Report: Mr. Naddeo recommended the supervisors advertise the Ordinance to approve the Joint Agreement, Home Rule Charter that would put it on the spring ballot for the residents to vote on the possible consolidation. Randy Powell motion to advertise the Ordinance, Daniel Mitchell second. Motion carried.

 

Recreational Park Board: No Report.

 

Code Enforcement Officer: The Code Officer presented the Subdivision for Clair Wriglesworth off of Sam Graham Road. It has been reviewed and approved by the Planning Commission. William Lawhead motion to approve the Wriglesworth Subdivision, Randy Powell second. Motion carried.

 

Code Officer Finkbeiner let the public know that the Clearfield Middle School is starting to do demolition of the building and to be alert while traveling in that area.

 

Roadmasters Report: No Report.

 

Secretary/Treasurer’s Report:

The Treasurer’s Report for the month of December was submitted for the Supervisors review.

 

The Secretary reported that the township received a letter from the Clearfield County Solid Waste Authority thanking the township for the support of their program designed to address the issue of illegal dumping. They also submitted a report for the 2016 Illegal Dumping Complaints for Clearfield County. We were presented with an Invoice if the township is interested in extending the Solid Waste Enforcement Services until March 18th, 2018 with a fee of $500.00. William Lawhead motion to approve extending the services at the fee of 500.00 until March 18th, 2018, Randy Powell second. Motion carried.

The Secretary explained that the township received an additional 125.00 in Amusement Tax after the Fire Companies were paid their 80%, therefore the township owes each Fire Company an additional 33.33 for 2016. Randy Powell motion to approve paying the additional amount of 33.33 to each Fire Company, William Lawhead second. Motion carried.

 

The Secretary reported that the townships share of the Building Permits and Inspection Fees for 2016 was 17,347.49 and asked permission to transfer those funds to the Reserve Account. William Lawhead motion to approve the transfer of funds, Randy Powell second. Motion carried.

 

The Secretary asked the supervisors to approve Resolution #2017-02 to destroy Old Records. William Lawhead motion to approve Resolution #2017-02 to destroy old records according to the list, Randy Powell second. Motion carried.

 

The Secretary asked permission to transfer funds from the General Fund to the Non Uniformed Pension Plan for the 7% of wages for 2016 in the amount of 24,303.07. Randy Powell motion to approve the transfer of funds, William Lawhead second. Motion carried.

 

The Secretary also asked permission to transfer funds from the General Fund to the Fire Company Reserve Account for the 2 Mills of taxes paid to the township in 2016 in the amount of 76,996.05. William Lawhead motion to approve the transfer of funds, Randy Powell second. Motion carried.

 

The Secretary asked permission to transfer funds from the TAN Account to the General Fund in the amount of 120,000.00 to pay the bills. Randy Powell motion to approve the transfer of funds, Daniel Mitchell second. Motion carried.

 

The Secretary reported the she received information from the Clearfield County Tax Assessment Office that they are holding a meeting on February 15th, 2017 to discuss the field assessors process of evaluating properties and timely submission of building permits among other topics. She asked permission for both herself and the Code Officer to attend. Randy Powell motion to approve both attending, Daniel Mitchell second. Motion carried.

 

The Secretary and Code Officer together presented information from the Community Innovation Zone (CIZ) pertaining to placing Little Free Libraries in the two low income housing areas located in Lawrence Township. This is for access to free books for children. Randy Powell motion to approve, William Lawhead second. Motion carried.

 

The Secretary presented a Resolution that Penndot is asking the township to approve the chairman to be authorized to submit the Application for Traffic Signal Approval to the Pa. Department of Transportation and to sign this application on behalf of the Municipality. Randy Powell motion to approve Resolution #2017-03, William Lawhead second. Supervisor’s Report: Daniel Mitchell: At the Reorganization Meeting the Secretary’s wages were increased to 18.10 hr and the Assistant to the Code Officer. We increased the Code Officer to 13.42 hr, how can we pay the Secretary more to be the assistant than the Code Officer. Supervisor Lawhead explained that the Code Officer is part Time and that is what she gets paid as. The Secretary tried to explain that the reason that was done several years ago, is just in case something would happen to the Code Officer then the permits can still be done but is only done in an emergency. William Lawhead motion to drop the title for Barbara Shaffner as the Assistant Code Officer and if the Code Officer is not here then nothing will get done, Daniel Mitchell second. Motion carried.

 

Supervisor Mitchell also questioned the fact that the he felt when the Code Officers hours were set for 2017 that she is getting less hours. The Secretary explained that she was given 32 hours as scheduled hours at the Reorganization Meeting but the supervisors did not state at that time granting additional hours with approval. Daniel Mitchell motion for the Code Officer to get approval from two supervisors for any hours over 32 hours per week and not to accede 36 hours per week, Randy second. Motion carried.

 

Randy Powell motion to conduct the next township meeting on February 7th, 2017 at one of the Fire Halls and the Secretary to contact the Fire Companies and make the arrangements, William Lawhead second. Motion carried.

 

William Lawhead motion to pay the list of bills in the amount of 103,641.76, Daniel Mitchell second. Motion carried.

 

No other business to come before the Board.
