Chairman William Lawhead called the meeting to order.

Pledge of Allegiance to the Flag.

Roll Call of Supervisors present showed: Glenn Johnston, Edward Brown and William Lawhead all present.

Present: Secretary Barbara Shaffner, Code Officer Zachary Lawhead, Police Chief Jeff Fink, Solicitor’s James Naddeo & Linda Lewis.

Public: Jeff Corcino-The Progress, Julie Rickard-The Courier Express and Nick Cordiano.

Comments from the Audience: Mr. Cordiano from Willow Drive area asked Supervisor Lawhead when he intended on replacing the Catch Basin that sunk at the corner of Willow Drive and Forest Drive. Mr. Lawhead let him know that he had it scheduled for the previous week but with the heavy rain on Thursday it is rescheduled for this week.

Edward Brown motion to approve the minutes of the September 21st, 2010 meeting as written, Glenn Johnston second. Motion approved.

Engineer’s Report; None.

Police Report: None.

Solicitor’s Report:Mr. Naddeo let the supervisors know that he received emails from Stiffler McGraw pertaining to change orders for the sewer project and the requested change in the retainage amount from 10% to 5%. The Engineer did not receive the certified payrolls from the contractor and there would not be a request for payment at this time.

Mr. Naddeo let the supervisors know that there has been a meeting scheduled for October 18th at 10:00 AM with the Police Union for the Police Contract.

Mr. Naddeo prepared a revised Developer Agreement for the supervisors review.

Mr. Naddeo prepared an amendment for Ordinance #2002-23 pertaining to Section 6.05-dealing with Killed In Service for the Police. It is now covered by the state and was recommended by Mockenhaupt Benefits Group to remove that section from the Ordinance. William Lawhead motion to adopt a Resolution to amend Ordinance #2002-23, Section 6.05, Killed In Action Benefit, Edward Brown second. Motion carried.

Mr. Naddeo asked to go to Executive Session at the end of the meeting to discuss a personnel issue and  a possible Resolution for Health Care.

Code Enforcement Officer: Zac Lawhead received a request from a resident on Moose Street to temporarily close an alley while he is putting on a new roof so he is able to put a dumpster in the alley. The supervisors requested that the property owner use reflectors and barriers around the dumpster and notify emergency services that the alley would be temporarily closed.

Secretary/Treasurer’s Report: The secretary let the supervisors know that the township received the funds from the Insurance Company for the repairs to the Tiger Mower in the amount of $5,651.90.

The Secretary let the supervisors know that the township received the funds for the Fire Relief in the amount of $45,497.20 and the funds were deposited into the General Fund and paid out to the Lawrence Township Fire Relief.

The township also received the funds for the Pension Plans in the amount of $97,045.27. The MMO obligation for the Police Plan for 2010 is $68,741.00 and the non-uniformed is $32,331.00. The Secretary deposited $68,741.00 into the Police Plan as required and the balance of $28,304.27 into the non-uniformed. At the end of 2010 the 7% for the non-uniformed will be calculated and the balance needed will be deposited at that time from the General Fund.

The township also received a letter from the State for our allocation for liquid fuels (Act 655) for 2011 is $264,222.65 and the Turnback Funds (Act 32) allocation is $44,840.00 giving a total of $309,062.65. The allocation for 2010 was 309,236.96, about $175.00 higher than 2011.

The Secretary let the supervisors know that the Clearfield County Tax Collection Committee voted and elected Keystone Collections Group as the County Wide Collector for the wage tax and the Local Services Tax beginning in 2012 for a 3-year contract.

The Secretary let the supervisors know that the Audit from Jewell Electric for the First Energy Grant to replace the lights at the Hyde Building has been completed and the township now needs to apply for the funds so the money is set aside for the materials while funds are still available. William Lawhead motion to apply for the energy grant through First Energy for the Hyde Building, Glenn Johnston second. Motion carried.

The township Engineer prepared the documents to apply to the Department of Environmental Protection for a permit to replace the pipe under Hill Street that goes into Stinky Run. Glenn Johnston motion to apply for permit and authorize the chairman to sign the necessary documents, William Lawhead second. Motion carried.

Supervisor’s Report:

Edward Brown: No Report.

Glenn Johnston asked when Maxwell is to have the contract completed. Supervisor Lawhead let him know that the pipe is to be in the ground this month but was unsure of the exact day.

William Lawhead asked the Secretary to open the bids for Winter Road Materials.

Supervisor Lawhead handed out a schedule for the Fall Leaf Pick up.

Edward Brown motion to pay the list of bills in the amount of $27,382.63, Glenn Johnston second. Motion carried.

William Lawhead motion to adjourn to Executive Session to discuss a personnel issue and a Resolution for Health Care, Edward Brown second.

William Lawhead motion to return from Executive Session, Edward Brown second.

7:45 P.M.

Edward Brown motion to adopt Resolution #2010-10 to authorize how the Health coverage deductibles are billed to the employees, Glenn Johnston second. Motion carried.

No other business to come before the Board.
