Chairman William Lawhead called meeting to order.

Pledge of Allegiance to the Flag.

Roll call of supervisors present showed Edward Brown, Glenn Johnston and William Lawhead all present.
Present: Secretary Barbara Shaffner, Code Officer Zachary Lawhead, Police Chief Jeff Fink, Solicitor’s James Naddeo & Linda Lewis.

Public: Kim Finnigan-Courier Express, Amanda Thompson-WOKW, Wendy Lynn-The Progress, Jason Collins, Paula Marshall, Joyce Falger and Gwen Fox all from the Joseph & Elizabeth Shaw Public Library.

Comments from the Audience: Board members of the Joseph & Elizabeth Shaw Public Library, Gwen Fox & Joyce Falger, were present to let the supervisors know what programs the Library has available and both spoke in support of the Library. The Library has all types of books and computers with internet access, and they also have Art Shows. They both thanked the supervisors for their donation but also let them know that if the township is able to give more of a donation then they would receive more from the state.

Glenn Johnston motion to approve the minutes of the October 19th, 2010 meeting as written, Edward Brown second. Motion approved.

Engineer’s Report: None.

Police report: Chief Fink gave the supervisors a copy of the Stats for October.

Chief Fink let the supervisors know that the Police Station was asked to participate again in the Officer Awareness Program at Dubois High School and also an Officer has been trained in Survival 101. Both programs were done at no cost to the township, the employee, J. Michael Morris donated his time for both programs.

Solicitor’s Report:Mr. Naddeo prepared and advertised Ordinance #2010-04, the third amendment to the Police Pension. This would delete Section 6.05 of Ordinance #2002-23, which is for Killed in Service Survivor Benefit, and is now covered by the state. Glenn Johnston motion to pass a Resolution to adopt Ordinance #2010-04, Edward Brown second. Motion approved.

Mr. Naddeo asked the supervisors if they knew what amount they would be asking for the TAN Loan so he would get the letters sent out to the Financial Institutes. Since there has not been a budget meeting yet the supervisors let him know that they would have the amount by the next meeting.

Mr. Naddeo asked the supervisors to go to Executive Meeting at the end of the meeting to discuss a Personnel Issue.

Code Enforcement Officer: Zachary Lawhead- No Report.

Secretary/Treasurer: Barbara Shaffner let the supervisors know that the township received Pay Estimate #10 for the Phase II Sanitary Sewer Project to Maxwell Trucking in the amount of $232,076.72. The pay estimate reflects retainage of $230,729.38 and covers the period between September 27th, 2010 and October 23, 2010. The project is behind schedule when considering that as of this pay estimate, 90.5% of the work is complete while the contract time has expired. Supervisor Johnston asked if Maxwell had submitted and was up to date with Certified Payrolls and if they also submitted for substantial completion. Mr. Naddeo let him know that he was not sent anything on Certified Payroll, and Supervisor Lawhead let him know that they had not received the substantial completion. Supervisor Johnston wanted to go over the pay estimate with the township Engineer and asked to table the decision to the next meeting.

After further discussion Supervisor Lawhead made a motion to approve Pay Estimate #10 in the amount of $232,076.72, Edward Brown second with Supervisor Johnston voting no.

The Secretary asked the supervisors what evenings they would be available to have work sessions for the 2011 Budget. The dates were set for Monday, November 8th and Wednesday, November 10th, 2010 at 6:30 P.M.

Supervisor’s Report:

Edward Brown: No Report.

Glenn Johnston: No Report.

Supervisor Lawhead let the other supervisors know that he received a request from Brian Jury asking the township for relief for his water used to fill his pool and not discharged into the sewer system and not be charged the sewer surcharge. Supervisor Johnston asked if residents still have to pay the surcharge when they water their lawns and gardens, which they do. The supervisors agreed that this was not a valid request and denied the request.

Supervisor Lawhead asked the Police Chief to look into an issue and a complaint that he received about a resident that parks along Fire Tower Road near Wrigley Street and is parked out onto the roadway.

Supervisor Lawhead received a complaint from a resident in the Susquehanna Terrace area about a neighbor’s storm water running onto their property and asked Mr. Naddeo if this was something the township would be involved in or if it was between property owners. After a lengthy discussion it was realized it could possibly be caused by the swale not being put back after the sewer project and Supervisor Lawhead will look into the issue further.

Glenn Johnston motion to reject the proposed Police Contract and go to arbitration, Edward Brown second. Motion approved.

No other business to come before the Board.

Glenn Johnston motion to adjourn, Edward Brown second.
