Chairman William Lawhead called the meeting to order.

Pledge of Allegiance to the Flag.

Roll call of supervisor’s present showed Glenn Johnston, Edward Brown and William Lawhead all present.
Present: Secretary Barbara Shaffner, Solicitor James Naddeo, Zoning Hearing Board Members Nancy Yeager and Randy Powell.
Public: List attached.

Public Comments: Matt Milliron was present regarding the zoning change request that was recently submitted from Jim Rishel between SR 322 and Turnpike Avenue. Mr. Milliron felt that the village district is not anti retail and that the township should not wait to update their zoning. He also felt the township should consider hiring a consultant to look over all the zoning and get it done as soon as possible.

Nancy Yeager let the public know that the Supervisors, Planning Commission and Zoning Hearing Board conducted workshops to work on updates and changes to the zoning. She felt that the discussions went very well and a lot was accomplished with the workshops.

Glenn Johnston motion to approve the minutes of the July 19th, 2011 meeting as written, William Lawhead second. Motion carried.

Engineer’s Report: None.

Police Report: None.

Solicitor’s Report: Mr. Naddeo let the supervisors know that he would like to have an Executive Session to discuss the Police Contract that is in Arbitration and also the township received a letter that a mediator has been appointed on behalf of the Non-Uniformed for their contract, and he would like to discuss that also.

Mr. Naddeo was given a copy of a proposed Ordinance to amend the township existing Earned Income Tax Ordinance from the Clearfield County Tax Collection Committee Solicitor. He felt it is similar to what the township already has but highlighted a few areas for the supervisors to consider. The supervisors were given a copy to review.

Mr. Naddeo was asked by the Code Officer to look into a Fireworks Ordinance to help her and direct her in enforcing Fireworks Permits. Mr. Naddeo looked into finding an Ordinance and had one for the supervisors to adopt. The supervisors tabled the Ordinance until the next meeting so they could review the Ordinance first.

The township received information from the townships Engineer’s Office that is called an Integrity Policy and it was given to the Solicitor for his review. Supervisor Brown and Johnston had not review the policy yet and asked to have a copy to review before making any decisions.
Mr. Naddeo was given a copy of the zoning changes that the Boards had discussed at their workshops. Mr. Naddeo did quote a section of the current zoning for permitted uses, conditional & special exceptions 124-14 line c. He felt this wording can help when a use if not listed.

Mr. Naddeo let the supervisors know that the township received a notice that they are party to a Class Action lawsuit involving municipal derivatives. Mr. Naddeo felt that the township does not purchase derivatives on its own but it is possible that it could have been done by investments for the Pension Plans. Mr. Naddeo will contact the Plan Administrator for the Pension Plans to find out if it was possible that they would have been purchased with Pension Funds. If they have then it may be possible that the township would receive some monetary compensation but he does not believe it would be a large amount.

Mr. Naddeo spoke with the President of Clearfield Borough Council pertaining to the Clearfield Economic Development Property. It was previously discovered when they applied for a Subdivision that Clearfield Borough was receiving all the real estate taxes for the property and some of the property is in the township. Mr. Naddeo was told that once the subdivision is complete the property will be divided and they will know what is in the township and what is in the Borough. He also let them know that the property is in the LERTA area.

Mr. Naddeo was given a copy of an Ordinance to review and prepare at a previous meeting for the Scenic By-Way to include a portion of SR 879. He let the supervisors know that the Ordinance was ready to implement. Edward Brown motion to approve the Scenic By-Ways Ordinance, Glenn Johnston second. Motion carried.

Recreational Park Board: No Report.

Code Enforcement Officer: No Report.

Secretary/Treasure: The Secretary let the supervisors know that the unexpired term on the Clearfield/Lawrence Township Joint Airport Authority was advertised and they only received one letter of interest and it was from Paul Snyder. William Lawhead motion to advertise again with hope of receiving more then one letter, Glenn Johnston second. Motion carried.

Supervisor’s Report:
Edward Brown: No Report.

Glenn Johnston asked Supervisor Lawhead if the company that is looking at going into the Industrial Park would be able to go in with the changes that the Boards looked at in the workshops. Supervisor Lawhead felt if the changes are made they would be able to locate in that area but at this point was not able to reveal the information.

Supervisor Lawhead received the letter from the townships Engineer for their review for HRI’s Land Development. Karla Coudriet was present and reviewed the comments and felt everything is in order. William Lawhead motion to approve the HRI Land Development, Edward Brown second. Motion carried.

Supervisor Lawhead let the public and media know that the township will have Riverview Road closed on Tuesday, August 9th, 2011 beginning at 8:30 AM to remove trees and replace pipe.

The Clearfield County Conservation District asked the township to consider being the applicant for a Growing Greener Grants for additional clean up of Montgomery Run. William Lawhead motion to approve applying for Growing Greener Grants, Edward Brown second. Motion carried.

Glenn Johnston motion to pay the bills in the amount of $184,187.33, William Lawhead second. Motion carried.

Edward Brown motion to go to Executive Session to discuss the Police litigation and also the Non-Uniformed Contract, Glenn Johnston second.
