Chairman William Lawhead called meeting to order.

Pledge of Allegiance to the Flag.

Roll call of supervisors showed Glenn Johnston, Edward Brown and William Lawhead all present.

Present:Secretary Barbara Shaffner, Code/Zoning Officer Agatha Lauder-English, Solicitors James Naddeo & Linda Lewis, Zoning Hearing Board Member-Rex Read.

Public: Kim Finnigan-The Courier Express, Amanda Thompson-WOKW, Jeff Corcino-The Progress, Aaron Evans-Gant Daily, Zac Lawhead-Hyde Fire Chief, Scott Kohne, Chris Vassallo, LeeAnn Wainwright, Seth Frazer-Chief Oil & Gas.

Comments from the audience: Zac Lawhead-Fire Chief for Hyde Fire Company was present to ask the supervisors if they would consider letting the Fire Company continue with Recycling. It was decided by the supervisors at their meeting held on July 5th, 2011 to hire two part time employees to take care of the recycling because they were told that Mill Road and Hyde Fire Companies were not doing the collecting. Fire Chief Lawhead said that the Hyde Fire Company had been doing the recycling and would like to continue. Supervisor Brown felt that he would like to see the township stay with the decision that was previously made and give it a chance to see how it works out with the hiring of employees to do the recycling. Supervisor Johnston also felt the same way and would like to see how the process works with hiring of employees to handle the recycling. Fire Chief Lawhead still would like to continue with the drop off site at their location, which the supervisors agreed with and the township will add the information onto their website. The Fire Company is to get any of their weigh slips to the township office so we have the information for our yearly report to DEP.

Fire Chief Lawhead also discussed a FEMA Grant that is now open and the Fire Company would like to apply for towards purchasing a New Engine Tanker, because their present one is outdated and in need of repairs. He felt it would cost between $250,000.00 to $300,000.00. Supervisor Brown asked him to get more details, cost and specs for the unit and email them to the township secretary so they can look them over before making a decision. Supervisor Lawhead asked him to be sure that when they spec one out that they do not add a lot of extras into the specs that are not needed.

Glenn Johnston motion to approve the minutes of the August 2nd, 2011 meeting as written, William Lawhead second. Motion carried.

Solicitor’s Report: Mr. Naddeo explained that the Scenic By-Laws Ordinance that he had discussed at the last meeting is on hold due to the state still debating on the parameters and have not decided what sections of the highway are to be included.

Mr. Naddeo had given the supervisors a copy of the EIT Tax Ordinance at the last meeting for them to review and decide if they wanted any changes.

Mr. Naddeo also gave the supervisors a copy of a proposed Fireworks Ordinance and Supervisor Lawhead let him know that he was not sure if that Ordinance is what the township is looking for. The Code/Zoning Officer explained what she is looking for but Mr. Naddeo felt the Ordinance covered what they wanted and it would give them the control that the township needed. Supervisor Brown felt some of the Ordinance needs eliminated but the township needs proper coverage and possibility a disclaimer clause, and also specify the use of Class C Fireworks. They will work on what changes need to be made.

Mr. Naddeo let the supervisors know that he has arranged a telephone conference with Mr. DeLuca, who represents the Police Department, and it is set up for the middle of September.

Recreational Park Board; No Report.

Code/Zoning Officer: Agatha let the supervisors know that all of the Mobile Home Park License for 2011 have been paid and there is only one Recycling/Junk Yard License that has not been paid but should be paid the next day.

The Code/Zoning Officer let the supervisors know that there is a request for a Conditional Use Hearing for Metzler Timbering that needs to be scheduled and also a Public Hearing for the proposed changes for adding uses for Zoning. The meetings were scheduled for September 6th, 2011 at 6:30 PM for the Zoning and 6:45 PM for the Timbering.

Agatha let the supervisors know that the Planning Commission approved the William Daisher minor Subdivision of two lots on Daisher Lane in Baneyville and passed to the supervisors. William Lawhead motion to approve the Daisher Subdivision, Glenn Johnston second. Motion carried.

The Code/Zoning Officer asked the supervisors if they were ready to make a decision for the Zoning Conditional Use request from Ron Porter for an Automobile Sales & Service business located at 1126 South 2nd Street, Clfd. The Hearing was held at 6:45 P.M. before the Regular Township Meeting. Edward Brown motion to approve the request from Ron Porter for an Automobile Sales & Service Business at this location in a Commercial District, Glenn Johnston second. Motion carried.

The Code/Zoning Officer also asked the supervisors if they were ready to make a decision for the Zoning Conditional Use submitted by Chief Oil & Gas to operate a Gas Well Pad in a Rural Agricultural District located on Flood Road in the Glen Richey area. William Lawhead motion to approve the request from Chief Oil & Gas to operate a Gas Well Pad in a Rural Agricultural District on Flood Road, Edward Brown second. Motion carried.

The Code/Zoning Officer let the supervisors know that the township received a letter from the Zoning Hearing Board to let them know their decision for the Zoning Appeal for Joseph Kendrick to operate a Winery in a Rural Agricultural area located on Carbon Mine Road. The Zoning Hearing Board overruled the Code/Zoning Officers decision on her finding that the proposed use is not a permitted home occupation and granted the applicant’s application for relief in the form of an appeal from the determination of the Zoning Officer.

Secretary/Treasurer’s Report: The Treasurer’s Report for the month of July was submitted to the supervisors for their review.

The Secretary readvertised the unexpired term on the Clearfield/Lawrence Township Joint Airport Authority and received two letters of interest from township residents, which were from Paul Snyder and Jerry Kaufield. William Lawhead motion to appoint Jerry Kaufield to the unexpired term on the Airport Authority to run until April 15th, 2015, Edward Brown second. Motion carried.

The secretary let the supervisors know that she advertised the Crossing Guard position for the Plymptonville School Crossing and the township received two applications, one from James Shepler and Clarence Ramsey. William Lawhead motion to appoint James Shepler as part time Crossing Guard, Glenn Johnston second. Motion carried.

The Secretary let the supervisors know that she looked into prices for Recycling Bins because she felt if the township is hoping to get residents involved in recycling again it would be helpful to have the bins available. She let the supervisors know that she had placed the recycling funds that the township received from DEP in the Reserve Account and they presently have $22,468.00 in that account for recycling. The prices for bins are from Busch Systems International, which is the location that she was given by the Clearfield County Solid Waste:

14 Gallon     $10.95 each

16 Gallon     $11.95 each

18 Gallon     $13.95 each

William Lawhead motion to authorize the Secretary to get more quotes and purchase 300 recycling bins from the cheapest quote, Edward Brown second. Motion carried.

The Secretary asked the supervisors if they wanted her to advertise for bids for Winter Road Materials. William Lawhead motion to advertise for 1,800 ton (more or less) 1B Limestone and 1,200 Ton (more or less) 6S Anti Skid Material, Glenn Johnston second. Motion carried.

The Secretary asked permission to purchase a new office chair at a cost of $189.99. Glenn Johnston motion to approve purchase, Edward Brown second. Motion carried.

Supervisor’s Report:

Supervisor Brown explained that he had reviewed the Integrity Policy and made a motion to approve, Glenn Johnston second. Motion carried.

Supervisor Brown had looked over the EIT Ordinance and made a motion to reenact the township’s Earned Income Tax Ordinance as is, William Lawhead second. Motion carried.

The Secretary asked the supervisors if they also wanted to address the Local Services Tax Agreement with Keystone Collection Group and authorize them to also collect this tax. William Lawhead motion to approve the Local Services Tax Agreement with Keystone Collection Group, Glenn Johnston second. Motion carried.

Glenn Johnston: No Report.

William Lawhead motion to deny the James Rishel rezoning request. Motion died with lack of a second.

William Lawhead motion to pay the list of bills in the amount of $90,387.06, Edward Brown second. Motion carried.

No other business to come before the Board.

Glenn Johnston motion to adjourn meeting, William Lawhead second.
