Chairman William Lawhead called the meeting to order.

Pledge of Allegiance to the Flag.

Roll call of supervisors present showed Edward Brown and William Lawhead present. Glenn Johnston absent.

Present: Secretary Barbara Shaffner, Solicitor’s James Naddeo & Linda Lewis, Engineer Eugene Zanella, Zoning Hearing Board member Randy Powell.

Public: Amanda Thompson-WOKW, Kim Finnigan-The Courier Express, Steve McDole-Gant Daily, Charles Bungo, Jeff Corcino-The Progress.

Comments from the audience: None.

William Lawhead motion to approve the minutes of the September 20th, 2011 meeting as written, Edward Brown second. Motion carried.

Engineer’s Report: Eugene Zanella presented Resolution #2011-06 for the 2011 CDBG Resolution of Approval and also the Township’s Statement of Goals for the National Program for Minority and Women Business Enterprise Executive Order 11625. Both were presented for the supervisor’s approval. William Lawhead motion to approve Resolution #2011-06 and the Statement of Goals, Edward Brown second. Motion carried.

Police Report; None.

Solicitor’s Report: Mr. Naddeo had advertised the EIT Ordinance where the supervisors had reenacted the present EIT as is. There was question on how many times it is required to be advertised. Mr. Naddeo felt that if it were found that it is required to be advertised more then it was then they would have to approve and advertise again. William Lawhead motion to approve Ordinance #2011-07-Earned Income Tax, Edward Brown second. Motion carried.

The Solicitor also advertised the amendments to the Zoning Ordinance and was ready for adoption. Edward Brown motion to approve Ordinance #2011-08 to amend Ordinance #125, William Lawhead second. Motion carried.

Mr. Naddeo asked the supervisors if they wanted to go to Executive Session to discuss the letter that the township received from the Teamster Union #205 for the roadcrew contract. Supervisor Brown had not gone over the letter yet and wanted to wait before they discussed and reviewed the current contract.

Mr. Naddeo also let the supervisors know that there is still some dilemma on the Flood Plain Ordinance and whether FEMA has accepted the approved Ordinance that was sent in. The solicitor has received two letters from two different individuals at FEMA stating that some changes needed to be made before they would approve the Ordinance from the township, but the change request are different from each individual. The solicitor is waiting to hear back from them about the changes before anything further can be done.

Recreational Park Board: No Report.

Code Enforcement Officer: No Report.

Secretary/Treasurer: There was a request from Clearfield DFC, Inc. for LERTA in a section of the old Bilo store that Save-A-Lot will be going into, proposed area of 18,267 sq ft. William Lawhead motion to approve the LERTA request from Clearfield DFC, Inc., Edward Brown second. Motion carried.

The Secretary let the supervisors know that the township received the 2011 MMO in the amount of $151,878.92. This will cover the Police MMO which is $126,008.00 and the Non-Uniformed is $32,480.00. The Non-Uniformed will be calculated at the end of the year according to their wages at 7% and the difference will have to be paid by the township.

The Secretary let the supervisors know that it is time to advertise for Engineering Services for our CDBG Programs that is to be done every three years. Edward Brown motion to advertise, William Lawhead second. Motion carried.

Supervisors Report:

Edward Brown: No Report.

Glenn Johnston: Absent.

Supervisor Lawhead let the public know that the Railroad Crossing on Industrial Park Road is going to be replaced and that end of Industrial Park Road will be closed during that time period. There will be a two week notice given before the contractor starts on the project.

Supervisor Lawhead let Supervisor Brown know that he received quotes from two Engineering Companies to evaluate the township’s set backs and height restrictions and gave him the information. It was decided to table any decision until the next meeting.

William Lawhead motion to pay the bills in the amount of $28,444.96, Edward Brown second. Motion carried.

No other business to come before the board.
