Vice Chairman Glenn Johnston called the meeting to order.

Pledge of Allegiance to the Flag.

Roll call of supervisors present showed Glenn Johnston and Edward Brown both present with William Lawhead absent.

Present: Secretary Barbara Shaffner, Code Officer Agatha Lauder-English, Solicitors James Naddeo & Linda Lewis, Nancy Yeager-Zoning Hearing Board member.

Public: Kim Finnigan-The Courier Express, Aaron Evans-Gant Daily, Jeff Corcino-The Progress, Charles Bungo, Bernice Lanich.

Comments from the Audience: Bernice Lanich-was not yet present.

Edward Brown motion to approve the minutes of the October 4th, 2011 meeting as written, Glenn Johnston second. Motion carried.

Engineer’s Report: None.

Police Report: None.

Solicitor’s Report: Mr. Naddeo let the supervisors know that after reviewing the issue of how many times the EIT Ordinance needed to be advertised he felt it was done correctly and recommended leaving it as it is.

Mr. Naddeo let the supervisors know that he received information for a proposed stipulation order for a Tax Appeal for one of the cell towers located in the township owned by Crown Communications. The Solicitors for the County and School District have come to the conclusion that the settlement negotiated by the County Solicitor is appropriate under the circumstances and ask for a motion to approve Mr. Naddeo as representative for the township to enter into a consent order so we can reconcile the consent order. Mr. Naddeo also let them know that if they agree then there would be a tax refund for the years 2009-2010-2011 & 2012 and felt it would be approximately $1,200.00 per year. Edward Brown motion to approve the solicitor entering into a consent agreement with the Solicitors for the School District and the County, Glenn Johnston second. Motion carried.

The Solicitor reminded the supervisors that they needed to set up a meeting to discuss the Non-Uniformed (Roadcrew)Contract. The date was set for October 25th, 2011 at 7:00 P.M. at Mr. Naddeo’s office.

Mr. Naddeo let the supervisors know that there is a situation with a township resident regarding a fence that was put up that violates the zoning code on Hill Street and the township received a correspondence from the Federal Housing pertaining to the Fair Housing Act. Mr. Naddeo was not sure that the Fair Housing Act pertains to the township but did explain some information that he was given. He is looking into and gathering more information pertaining to the Act. There is an appeal to go before the Zoning Hearing Board scheduled for October 25th, 2011.

Comments from the Audience:Bernice Lanich was present to let the supervisors know of her concerns of water run off from a neighbor’s property on Nelson Road. She felt that after the neighbor paved his driveway it caused more water flow to come across the road and onto her property. After a discussion of whether the issue is a property dispute or may be causing damage to the township road the supervisors decided to have the township engineer look over the issue and give his opinion.  Mrs. Lanich let the supervisors know that the ditch also needed to be cleaned.

Recreational Park Board: None.

Code/Zoning Officer: The Code Officer let the supervisors know that the Planning Commission had approved a (2) two lot Subdivision for the Clearfield County Economic Development at 511 Spruce Street Clearfield. Lot 1 – 4.54 acres located in Lawrence Township and Lot 2 – 6.242 acres located in Clearfield Borough. Edward Brown motion to approve the Subdivision, Glenn Johnston second. Motion carried.

The Code Officer asked the supervisors if they were ready to make a decision regarding the quotes received from Engineering firms to evaluate the townships setbacks and height restrictions for our zoning. Both supervisors agreed that they wanted to wait until all three supervisors were present.

Secretary/Treasurer’s Report: The Treasurer let the supervisors know that she gave them a copy of the Treasurer’s Repot for September for their review.

The Secretary let the supervisors know that the township received $11,370.00 from the Insurance Company for the Ingersol Rand Bobcat that was stolen and that Roadmaster Lawhead was checking with companies to get prices to purchase a new one.

The township was give a request from Andrew Lingle asking for reimbursement of his sewer surcharge in the amount of $720.00 because of a water leak that he had. Clearfield Municipal Authority had already given him a refund for the water usage. Edward Brown motion to reimburse at the same percentage as the Clearfield Municipal Authority, Glenn Johnston second. Motion carried.

The Secretary let the supervisors know that the township received notification that the Liquid Fuels allocation for 2012 to budget will be Act 655- $279,349.25 and Turnback Act 32 $44,840.00.

The Secretary also let the supervisors know that Gary Bowman resigned as the alternate for the Zoning Hearing Board because he no longer resides in the township. Edward Brown motion to advertise for replacement, Glenn Johnston second. Motion carried.

The township received Pay Estimate #1 for the Sanitary Sewer Phase 2A Project from Continental Construction in the amount of $121,593.79. The Secretary did let the supervisors know that the original bid was for $144,961.00 plus there was a change order in the amount of $7,500.00 so the project was completed lower then expected. Glenn Johnston motion to approve Pay Estimate #1 to Continental Construction, Edward Brown second. Motion carried.

The Secretary did let the supervisors know that a substantial completion inspection was done on October 13th, 2011 for the Sanitary Sewer Project Phase II with Maxwell Trucking and the engineer estimated the value of the remaining work to be $2,000.00 so retainage of $3,000.00 should be reflected in the estimate. Both Supervisor Edward Brown and Glenn Johnston felt they would like to review everything with the engineer regarding the sewer project with Maxwell Trucking before any additional decisions are made.

The Secretary asked the supervisors to set an evening when they can start to work on the 2012 budget. The date was set for November 2nd, 2011 at 7:00P.M.

Supervisor’s Report:

Glenn Johnston: No Report.

William Lawhead: Absent.

Edward Brown motion to pay the bills in the amount of $74,378.31, Glenn Johnston second. Motion carried.

No other business to come before the Board.
